Principles of personal data processing
Mgr. et Mgr. Tereza Martincová, attorney-at-law, processes personal data manually, in both paper and electronic forms, as a data controller, and handles them in accordance with applicable legal regulations, especially in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation or "GDPR").
Purpose of processing
The attorney processes data of her clients and business partners who are natural persons ("data subjects") exclusively for the purposes specified below, based on the legal titles established by the GDPR, and to the extent necessary to fulfill the purpose for which they were collected.
- Performance of the legal services contract, including its negotiation, and fulfillment of obligations stipulated by contracts with business partners;
- Compliance with legal obligations, especially proper maintenance of the attorney's file, including email communication; client identification as per Act No. 85/1996 Coll., on Advocacy, as amended, and Act No. 253/2008 Coll., on Certain Measures Against Money Laundering, as amended;
- Protection of legitimate interest (protection of the rights and legally protected interests of the attorney and her clients);
- Sending commercial communications and offering services via email (sending commercial messages or newsletters based on Act No. 480/2004 Coll., on Certain Information Society Services and Amendments to Some Acts (Act on Certain Information Society Services), as amended).
Processed personal data
The attorney processes, in particular, the following personal data:
- Identification data – name, surname, title, date of birth, ICO, DIC, ID number;
- Contact data – address, phone number, email address;
- Financial data – bank account number;
- Data on the relationship of the data subject to the attorney;
- Data provided by the attorney's clients or their legal representatives within the performance of the legal services contract and in the course of activities directly related to it.
Retention period of personal data
Personal data are processed for the duration of the contract with the data subject or for the duration of the legal relationship in connection with which the data subject's personal data are processed. Personal data are processed for a longer period only if stipulated by law or justified by the need or potential for complete settlement of claims from the contractual legal relationship established between the attorney as the controller and the data subject or a third party, if personal data of the data subjects are processed in this context.
Recipients of personal data
The attorney is entitled or obliged, in cases stipulated by law, to provide some personal data to public authorities or entities authorized to perform tasks in the public interest, based on valid legal regulations.
In cases where the transfer of personal data is necessary for the provision of legal services by another legal service provider, the attorney acts in accordance with the Advocacy Act, according to which the attorney is bound by the confidentiality obligation when providing legal services.
Use of cookies

Data Subject Rights
Data subjects have the following rights according to personal data protection regulations:
- Right of access – the data subject has the right to obtain information from the attorney as the controller about whether their personal data are processed and, if so, what data is involved and how they are processed;
- Right to rectification – the data subject has the right to have the attorney correct inaccurate personal data concerning them without undue delay upon their request;
- Right to erasure (right to be forgotten) – the data subject has the right to have the attorney delete personal data concerning them if the specified conditions are met and the data subject requests it;
- Right to restrict processing – the data subject has the right to have the attorney, in certain cases, restrict the processing of their personal data;
- Right to data portability – the data subject has the right, if the specified conditions are met, to obtain from the attorney the personal data they provided and transfer it to another controller or, if technically feasible, request that controllers transfer personal data between themselves;
- Right to object to processing – the data subject has the right to object at any time to the processing based on the legitimate interests of the attorney, a third party, or necessary for the performance of a task carried out in the public interest or in the exercise of official authority;
- Right to withdraw consent – if the attorney processes personal data based on the data subject's voluntary consent, the data subject has the right to withdraw this consent at any time.
In the case of repeated or manifestly unfounded requests to exercise the above rights, the attorney is entitled to charge a reasonable fee for the implementation of the given right or to refuse its implementation.
